A SALISBURY man who was convicted of sexual assault after kissing a girl on a night out in Amesbury has had his name cleared by senior judges.

Jordan John White, 21, of Newmans Way, Bulford, was convicted of sexual assault at Salisbury Crown Court in June 2016.

The jury could not reach a verdict on a more serious count of assault by penetration but he was acquitted of that following a retrial in August 2016.

The Crown Court judge delayed sentencing Mr White until he had a chance to appeal against his conviction.

His barrister, Fern Russell, argued at London's Appeal Court this month that his sexual assault conviction was "unsafe" and should be overturned.

Witness evidence that supported Mr White's case that the kissing had been consensual was 'plainly capable of belief', said the barrister.

Lawyers for the Crown Prosecution Service claimed the evidence was 'simply not capable of belief' as the witness was 'not impartial'.

Lady Justice Thirwall, sitting with two other judges, heard the witness give evidence in court.

"We are quite satisfied that the evidence should be admitted in the interests of justice," she said.

"We have no difficulty in finding it to be capable of belief."

'Overwhelmingly' her evidence was that the kissing 'had not been other then consensual', the judge added.

"The evidence was credible, therefore we cannot be satisfied that the conviction in this case is safe and it must be quashed."

The case can only now be reported after the Crown Prosecution Service decided not to seek a retrial.
